§ 1-8. Ordinances not affected by adoption of Code.

  • (a)

    The repeal provided for in section 2 of the ordinance adopting this Code shall not affect any of the following:

    (1)

    Any offense or act committed or done or any penalty or forfeiture incurred or any contract or right established or accruing before the effective date of such Code;

    (2)

    Any ordinance promising or guaranteeing the payment of money for the city, or authorizing the issuance of any bonds of the city or any evidence of the city's indebtedness, or any contract or obligation assumed by the city;

    (3)

    Any contract approved or right or franchise granted by any ordinance of the city;

    (4)

    Any ordinance dedicating, accepting the dedication of, naming, establishing, locating, relocating, opening, paving, widening, vacating, etc., any street, alley, public way, public park or public place in the city;

    (5)

    Any appropriation ordinances;

    (6)

    Any ordinance levying, abating or imposing taxes or special assessments, or authorizing tax fund transfers not inconsistent with this Code;

    (7)

    The zoning ordinance or any amendment thereto, including ordinances changing zoning classifications and granting variance and special uses;

    (8)

    Any ordinance establishing or prescribing street or sidewalk grades in the city;

    (9)

    Any ordinance providing for local improvements and assessing taxes therefor;

    (10)

    Any ordinance dedicating or accepting any plat or subdivision in the city, or providing regulations for the subdivision of land;

    (11)

    Any ordinance establishing, extending or contracting the boundaries of the city;

    (12)

    Any ordinance prescribing the number, classification, or compensation of any city officers or employees, not inconsistent herewith;

    (13)

    Any ordinance declaring certain property to be a public nuisance and authorizing procedures for the demolition of same;

    (14)

    Any ordinance adopted by reference by any provision of this Code or any amendments to such ordinances;

    (15)

    Any ordinance establishing fire lanes on private property;

    (16)

    Any temporary or special ordinance, including intergovernmental agreements;

    (17)

    Any ordinance fixing sewer connection charges or other special service fees for specific areas;

    (18)

    Any ordinance or portion thereof establishing traffic regulations for specific streets or portions thereof or other areas in the city;

    (19)

    Any ordinance respecting conveyance, leasing or acceptance of real property or easements in real property;

    (20)

    Any election ordinance;

    (21)

    The annual prevailing wage rate ordinance;

    (22)

    Any ordinance concerning municipal retirement;

    (23)

    The exhibits to the ordinance concerning fences.

    (24)

    Ch. XXII, art. 1, §§ 1—15, art. 2, §§ 1—6, and Ch. XVIII, § 46, of the 1933 Revised Ordinances of the city concerning the regulation and/or licensure of certain businesses in the city.

    (b)

    All such ordinances are recognized as continuing in full force and effect to the same extent as if set out at length in this Code.
